toda profissão carrega um fardo, pra mim o maior fardo de nós militantes da área jurídica, (magistrado ao motivar a sentença, delegado ao investigar um inquérito, advogado ao tentar defender seu cliente, promotor, etc…) é provar a verdade, é trazer pra dentro dos autos o que foi apurado.

 A verdade dos fatos não é simples de se revelar, até porque o conceito de verdade é relativo, e muitas das vezes a verdade dos fatos se diferencia da verdade dos autos, e a verdade tem que ser processual, dentro dos autos e pode muito bem, não corresponder à verdade do mundo dos homens.

Outrossim, o erro é a falsa percepção da verdade, equívocos no deslinde de um crime são comuns e fazem parte da história da sociedade humana, se diferenciando apenas em razão da época e modo de julgamento.

“A justiça tarda, mas não falha.” O provérbio, sempre lembrado quando se chega a um bom desfecho, não é inexorável, existem casos em que a lei dos homens foi aplicada de maneira equivocada, branda e até maliciosa.

Das antiguidades aos dias de hoje, existem julgamentos políticos e polêmicos que escandalizaram a sociedade e ainda provoca debates sobre as decisões do poder judiciário, a título de exemplo e reflexão vou citar alguns casos de grave erro judicial.

 Lembrando que a sociedade é que deve estar atenta para que a justiça não extrapole seus limites, nem fuja aos seus deveres, afinal todo o poder emana do povo.
